Terms of Use

By accessing and using ctreserves.nz and ctreserves.provida.nz (Website) users (you) accept and agree to be bound by these Terms of Use (Terms). These Terms are important and legally binding so please read them carefully. If you don't agree to them, you should not use the Website.

The Website is created by the Contact Tracing Reserves (CTR, we, us). Please note that these Terms were updated on 18th September, 2021.

  1. Use: Users may only use the Website with these Terms. All rights not expressly granted to you in these Terms are reserved by CTR. 

  2. Privacy Policy: Our Privacy Policy applies to the handling, storage, and use of any personal information you submit to us and forms part of this Agreement. Please read our Privacy Policy carefully. 
  3. Responsibility: You are responsible for the activity that occurs through your use of the Website. CTR disclaims any and all liability for the content, representations, statements, services, products or other information posted to the Website by you. 

  4. Content uploaded: CTR reserves the right to remove any content posted to the Website which it considers (in its absolute discretion) to be offensive, objectionable or otherwise unlawful.

  5. Provision of information: When using the Website, you agree to provide true, accurate, current and complete information about yourself. Please ensure your information remains true, accurate, current and complete.

  6. No malicious or illegal use: Don't use the Website for any malicious means, or abuse, harass, threaten, intimidate or impersonate any other user of the Website. Don't use the Website for any illegal purpose or post any information that is in breach of any confidentiality obligation, copyright, trade mark or other intellectual property or proprietary rights of any person.

  7. Indemnity: You are responsible for all activity resulting from your use of the Website. You indemnify, and will keep indemnified, CTR against all forms of liability, actions, proceedings, demands, costs, charges and expenses which CTR may incur or be subject to or suffer as a result of your use of the Website.

  8. CTR Liability: To the maximum extent permitted by law, CTR shall not be liable, whether in contract, tort (including negligence) or otherwise, for any direct, indirect, consequential, special, exemplary or incidental damages, or for any lost profits, savings, revenue or data, legal fees or court costs in relation to any claim arising out of or in connection with these Terms, the Website or any services, features or content of the Website. If for any reason the foregoing limitation is not valid or enforceable, then CTR’s maximum aggregate liability to you in respect of any single claim or series of related claims will be NZ$1,000.

  9. Intellectual property: You agree that we own all of the intellectual property rights existing in the Website including any improvements, enhancements, modifications or adaptations to the Website. You agree not to, and will not permit or encourage any third party to, copy, reproduce, modify, adapt, reverse-engineer or decompile the Website in whole or in part without our prior written consent. You may not publish or use our brand, branding or logos without our prior written consent. We will not collect, store or claim ownership of any intellectual property rights in relation to the information that you submit to the Website. 

  10. Amendments: CTR reserves the right to amend these Terms and our Privacy Policy at any time for operational purposes and may also add new features that will be subject to these Terms. If these changes will impact privacy, security or safety concerns, we’ll let the CTR members know. If you continue to use the Website after any changes it will be taken to have agreed to the changes.

  11. Termination or suspension of accounts: If you do not abide by these Terms, CTR may terminate or suspend your account.

  12. Technical support and malfunctions: CTR will try to promptly address (during normal business hours) all technical issues that arise on the Website. However, CTR will not be liable for any loss suffered as a result of any partial or total breakdown of the Website or any technical malfunctions. 

  13. No waiver: If CTR does not insist that you perform any of your obligations under there Terms, or if CTR does not immediately enforce its rights against you, that will not mean that CTR has waived its rights against you and will not mean that you do not have to comply with those obligations. 

  14. Severability: Each of the conditions of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect. 

  15. New Zealand law: These terms are governed by New Zealand law. You agree that the High Court of New Zealand will have exclusive jurisdiction.
